People in the credit field have
always been required to be shrewd judges of character and to have
considerable financial acumen as well. Without these qualities, they
would be in poor position to make judgements regarding their clients
ability or willingness to repay. In addition, they have had to display
both patience and tenacity in their efforts to collect debts justly owed
them, but which, for one reason or another, clients refused to pay. In
the past decade, however, revolutionary changes have taken place in the
field of credit that have effectively made credit manager's jobs even
more difficult. In the period from the end of the 1960's to the present,
a myriad of credit laws have been passed. Today's credit manager, in
addition to having the qualities described above, must be fully
conversant with these laws if he or she is to perform the job
effectively--and it is no easy task! The laws overlap and intertwine. In
some cases federal laws take precedence over state requirement. In
other, the stricter law is enforced. In still others, credit managers
will find that they are required to comply with the provisions of two
sets of apparently conflicting laws.
From the moment you accept an
application for credit, and in some cases even before, as soon as you
make a credit decision, when you send out a credit billing, and so on
throughout the whole credit process until you have collected the debts
owed, you will find your actions are limited or you are required to
perform certain functions or make certain disclosures as a result of
these laws. No matter that the process is complex. You have no choice
but to comply.

does apply to any recovery firm, and any other act or law governing our
agency. We feel we have a larger responsibility to you than merely a
